Terms of Service

These Terms of Service ("Terms") govern your access to and use of Equalang (the "Service"), a translation tool available at equalang.com, together with its browser extension and API, operated by the Equalang team ("Equalang", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Please read these Terms together with our Privacy Policy, which explains how we handle your personal data. The Privacy Policy is incorporated into these Terms by reference.

1. Definitions

In these Terms:

  • "Service" means the Equalang website, browser extension, API, and related features made available at equalang.com.
  • "Input" means the documents, text, web pages, and subtitles you submit to the Service for translation.
  • "Output" means the translations the Service returns to you based on your Input.
  • "Credits" means the prepaid units you buy and spend to run translations on the Service.
  • "AI Provider" means a third-party artificial-intelligence model provider that processes your Input to generate Output.

2. The Service

Equalang translates text, documents, web pages, and video subtitles between languages, aiming to preserve the original layout, formatting, and meaning. The specific features available may change over time.

The Service uses third-party AI Providers to perform translation. Output is generated automatically and may contain errors, omissions, mistranslations, or inaccuracies. You are responsible for reviewing and verifying any Output before relying on or distributing it, and you should not rely on Output alone for legal, medical, financial, safety-critical, or other consequential decisions.

We may add, change, or discontinue features of the Service. We will not make changes that materially reduce Credits you have already purchased without a reasonable alternative or a refund of the affected Credits.

3. The browser extension

The browser extension translates the page you are reading. To do that it must read the text of pages on which you start a translation, and send that text to the Service for processing. It does this only for pages where you ask it to: by pressing its button, its floating control, or its keyboard shortcut.

The extension can be turned off per page, and uninstalled at any time. It does not read pages you have not asked it to translate, and it does not collect your browsing history.

4. Live interpreting, calls, and photos

Some features need a microphone or a camera. Live interpreting streams what you say to be recognised and translated as you speak; photo translation sends the picture you take. Your browser asks your permission before either is opened, and you can withdraw it at any time in your browser settings. We do not keep the audio — the record a session leaves behind is its text.

A call has someone else in it. Everything either of you says is recognised and translated so that the other can read it, and each of you keeps a record of the conversation. That makes it a shared conversation, and it is your responsibility, not ours, to have the agreement of the people you are talking to before you have one interpreted or transcribed. In some places the law requires their consent; where it does, obtaining it is your responsibility.

Machine interpreting is not a professional interpreter. It mishears, it guesses, and it drops things. Do not use it as the interpreter of record for medical consultations, legal proceedings, emergency or safety-critical situations, or anywhere the consequences of a mistranslation fall on someone who did not choose the tool. Where such a setting requires a qualified human interpreter, engage one.

5. Eligibility and accounts

You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it, in which case "you" refers to that organization.

You are responsible for the activity that occurs under your account and for keeping your login credentials and API keys secure. An API key can spend your Credits; treat it as a secret and keep it out of browsers, client applications, public repositories, and logs. Notify us promptly at support@equalang.com of any unauthorized use of your account.

6. Credits, pricing and payment

The Service is provided on a prepaid credit basis. You purchase Credits, and Credits are consumed when you run a translation. Credits are charged on the input tokens of the source text; the Output itself is not charged separately. The estimated cost of a document job is shown before you confirm it. A job that fails or is cancelled is not charged.

Payments are processed by our payment processors, Creem and Waffo Pancake (whichever is offered at checkout), each acting as the merchant of record for your purchase. Your card data is handled by the processor and is never stored on our servers. Prices are shown at checkout and are charged in the currency indicated; you are responsible for any applicable taxes not stated at checkout. Each purchase is a one-time charge, which you authorize by completing checkout; this is not a subscription and nothing recurs. Credits purchased directly do not expire. Credits granted as part of any promotion or plan may carry an expiry, which will be shown at the time they are granted.

We may change prices from time to time. Price changes do not affect Credits you have already purchased.

7. Refunds and cancellation

Because Credits are a prepaid digital product that is consumed when you run a translation, the following applies:

  • Unused credits: if you have not used any of the Credits from a purchase, you may request a full refund of that purchase within 14 days of the transaction; the corresponding Credits are then removed from your account.
  • Partially used credits: once some Credits from a purchase have been used, that purchase is generally non-refundable, because the digital service has been delivered for the portion used.
  • Service faults: if a job fails due to a fault on our side, the Credits reserved for it are returned automatically and you are not charged. If you were charged for a job that produced no usable result due to a technical fault, contact us and we will issue Credits or a refund as appropriate.
  • Result dissatisfaction: because Output is generated automatically, dissatisfaction with the wording or style of an otherwise-working translation is not by itself grounds for a refund; you can re-run a job with different settings.

To request a refund, email support@equalang.com with your account email and, if available, the order number. Refunds are issued through our payment provider to the original payment method. If you believe a charge is incorrect, please contact us before filing a card dispute. This policy does not limit any rights you have under the consumer-protection laws that apply to you.

8. Acceptable use

You may use the Service only for lawful purposes. You are solely responsible for the material you submit and for what you do with the translations it produces.

You may not use the Service, and may not permit anyone else to use it, to:

  • Translate or otherwise process content you do not have the right to use, copy, or create derivative works from. A translation is a derivative work: the right to make one has to come from somewhere.
  • Create or spread unlawful, defamatory, harassing, hateful, or infringing content, malware, or content that sexually exploits minors.
  • Present a machine translation as a certified, sworn, or officially attested translation where the law or an institution requires one.
  • Capture, interpret, or transcribe another person’s speech without the agreement the law where you are requires you to have.
  • Scrape, crawl, or use bots or other automated means to access the Service, except through the API as we permit; or resell, sublicense, or provide the Service to third parties as your own.
  • Circumvent, disable, or interfere with usage limits, credit metering, billing, rate limits, or any security or access control of the Service.
  • Use the Output to develop, train, or improve any competing artificial-intelligence or translation model or product.
  • Attempt to disrupt, overload, reverse-engineer, decompile, or gain unauthorized access to the Service or its systems.

Machine translation is not a certified translation. We make no promise that Output is accurate, complete, or fit for any official, legal, medical, or safety-critical purpose, and where such a purpose requires a qualified human translator, you must engage one.

9. Your content

You retain all rights to the material you submit ("Input") and to the translations the Service returns ("Output"). We do not claim ownership of your Input or Output.

You grant us a limited, non-exclusive, worldwide license to store, process, and transmit your Input and Output solely to operate and provide the Service to you — including sending your Input to the AI Providers that perform the translation, and storing your Input and Output so that you can access your history. This license ends when the relevant content is deleted from the Service, except for copies retained as described in our Privacy Policy.

We do not use your Input or Output to train AI models. We may generate and use aggregated or de-identified statistics about how the Service is used (for example, counts of jobs, token volumes, and reliability metrics) to operate, secure, and improve the Service. Such statistics do not identify you and do not include the substance of your Input or Output.

You represent and warrant that you have the necessary rights to the Input you submit and that neither it nor its translation infringes the rights of any third party or violates any law.

Feedback

If you send us suggestions, ideas, or other feedback about the Service, you agree that we may use it without restriction and without any obligation to you.

10. Third-party services

The Service relies on and may link to third parties, including our authentication provider, payment provider, cloud storage provider, and AI Providers. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services, and their inclusion does not imply our endorsement.

11. Our intellectual property

The Service, including its software, design, and brand, is owned by the Equalang team and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks, logos, or software except the limited right to use the Service as intended. We reserve all rights not expressly granted.

12. Copyright complaints

We respect intellectual-property rights. If you believe content processed through the Service infringes your copyright, contact us at support@equalang.com with enough detail to identify the work and the allegedly infringing material, your contact information, and a statement that you have a good-faith belief the use is not authorized. We will review and respond to valid notices, and may remove content or suspend accounts of repeat infringers.

13. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, that Output will be accurate, complete, or fit for any particular purpose, or that formatting and layout will be preserved in every document.

14. Limitation of liability

To the fullest extent permitted by law, Equalang will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold the Equalang team harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your Input, your Output, your use of the Service, or your violation of these Terms or applicable law.

16. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, or where necessary to protect the Service or comply with the law. If we terminate your account without cause, we will refund any unused Credits. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service.

18. Dispute resolution

If a dispute arises, please contact us first at support@equalang.com so we can try to resolve it informally; most concerns can be settled this way. If we cannot resolve it, the dispute will be handled by the courts identified under "Governing law" below, unless mandatory consumer-protection law in your place of residence gives you the right to bring proceedings elsewhere.

19. General terms

  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements on that subject.
  • Severability: if any provision is found unenforceable, the remaining provisions stay in effect.
  • No waiver: our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment: you may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.

20. Governing law and contact

These Terms are governed by the laws of the jurisdiction in which the Equalang team operates, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection law that applies to you. Questions about these Terms can be sent to support@equalang.com.
